1. Payment

1.1. Payment of this membership may be made via Cash, Credit Card, EFTPOS, or Direct Debit


2. Cooling-off Period

2.1. This contract of membership can be voided within 48-hours of joining. All terms and conditions are binding after this 48-hour period. The 48-hour period commences from 5:30am on the date of purchase.


3. Cancellation

3.1. All Memberships are refundable within the 48-hour cooling-off period, as noted in cooling-off period terms.

3.2. Termination within this period will incur an administrative fee to the lesser amount of $75 or 10% of the membership fee plus the cost of any services or use of facilities that have been provided. After this time, memberships will not be refunded.

3.3. In the event of permanent disability or sickness, refunds maybe granted where:

  • A letter from a medical practitioner detailing the disability or sickness is provided.
  • An administration fee to the lesser amount of $75 or 10% of the membership plus the cost of any services or use of facilities that have been provided has been deducted from the refund.
  • Memberships cannot be cancelled within any given Free Membership Period. Membership cancellation can only occur on a paid membership basis.
  • Direct Debit Memberships:
    • No minimum term membership – 30 days’ notice to cancel in writing
    • Contracted memberships - 30 days’ notice to cancel in writing. Cancellation fee if cancelled within the contract period = $199 or payout the remainder of their contract, whichever is the lesser amount

4. Suspension

4.1. Membership suspensions are charged at the cost of $0.50 per day, regardless of membership type. Suspension requests must be made in writing or through the member portal and in advance of the suspension starting date. Requests will not be accepted in retrospect. The suspension period is NOT part of the minimum term or the cancellation period.


5. Change of Membership / Membership Details

5.1. To ensure accuracy of records, any changes to membership type must be conducted in person at centre reception. Changes to member details can be conducted at centre reception or via the member portal.


6. Warning of potential harm and accepting of risk

6.1. I understand and acknowledge that whilst all reasonable care and skill is taken by the YMCA to ensure safe equipment, facilities and services, there are inherent risks of injury or ill-health resulting from the use of the gym facilities, use of gym equipment and from participating in physical activity and exercise in generally.

6.2. I understand that these risks may result in various injuries, including but not limited to, minor cuts and bruises, muscle strains, ligament and tendon sprains, bone fractures, neck and spinal damage, heart-attack, stroke, death or psychological illness.

6.3. I understand that these injuries or illness may impact my future ability to earn a living, engage in other business, social and recreational activities and generally enjoy life.

6.4. I understand that injuries maybe incurred as a result of the actions or inaction of other persons utilising the gym facility.

6.5. I understand and appreciate the inherent risk and potential impact of the types of injuries or illness that may result from use of the gym facilities and I agree that I am willingly and voluntarily participating in the use of gym facilities and equipment.


7. Indemnity and Waiver of Liability

7.1. In consideration of the known risks and potential for serious injury to the extent permitted by law. I and on behalf of my family, parents, guardians and an personal representatives or executors hereafter, hereby agree to forever hold harmless, release and indemnify the YMCA, its officers, employees, volunteers, agents and representatives from any and all claims, actions, suits, demands, losses and other liabilities and costs (including court, costs, legal and investigations fees or other expenses incurred) however so caused, in relation to any physical or psychological injury or illness or contractions disease (including any adverse change of any injury, medical condition or state of health, whether permanent or temporary) resulting from the use of the YMCA facilities, equipment or services.


8. Other

8.1. All Casual Health and Fitness Passes have an expiry date of six (6) months after date of purchase.

8.2. Membership cards must be presented before entering any program / class.

8.3. Members are required to follow the YMCA CODE OF CONDUCT, 24/7 CONDITIONS OF ENTRY, ALL SAFETY RULES, INSTRUCTIONS OR DIRECTIONS provided by the YMCA of Queensland employees or volunteers at all times, including wearing suitable clothing in the gym including enclosed footwear and singlet or shirt with shorts or pants and the use of TOWELS ON ALL EQUIPMENT.

8.4. As a member of the YMCA of Queensland, you understand that non-usage of facilities does not allow for early termination of this agreement nor does it warrant a refund of any type. You also agree and understand that any non-usage of the facilities does not affect any of the terms of this agreement and that the YMCA of Brisbane is in no way responsible for your level of usage nor is it responsible to notify you of your usage at any stage.

8.5. For their own safety CHILDREN ARE NOT ALLOWED INTO THE GROUP FITNESS OR GYM AREAS unless of the correct age as per our age policy and hold their own membership.

8.6. Members or applicants for memberships may be required to provide a certificate from a registered medical practitioner prior to being granted permission to participate in any exercise programs.

8.7. The INFORMATION WE COLLECT from members, is for the purpose of properly providing our services to you/your child, and will remain CONFIDENTIAL and will be used strictly in accordance with YMCA of Brisbane PRIVACY POLICY.

8.8. The YMCA of Queensland will not be held responsible for the damage or theft of any member’s personal property.

8.9. I agree to inform YMCA management, employee or volunteer of conduct or a condition that might endanger myself or others.


9. Off-Peak & Promotional Memberships

9.1. I understand that holding an Off-Peak Membership grants me access to the Health and Fitness centre during specifically designated times. Check with fitness centre reception for centre specific times.

9.2. I will not have access to the Health and Fitness centre if the centre is unstaffed even during the Off-Peak membership hours.

9.3. I understand that as part of an Off-Peak membership, I do not have access to the Health and Fitness centre outside of the designated membership hours and do not receive a 24/7 access pass. I understand that the designated Off-Peak membership hours may change throughout the course of my memberships due to business needs.

9.4. As part of an Off-Peak membership, I have access to all group fitness classes that fall during the designated hours of the membership.

9.5. Off-Peak Membership ONLY INCLUDES access to the outdoor pool (YMCA site specific) during standard pool operation hours that fall within the designated hours of the membership.

9.6. I understand that when signing to any Promotional Membership terms and conditions that conflict with the standard membership terms and conditions, that the Promotional Membership terms and conditions will take precedence.


10. Concession Rates

10.1. I understand that to receive the concession rate, I must provide a valid and accepted concession card at the time of signing.

10.2. I understand that should my concession card become expired, a new valid and accepted concession card must be provided prior to the expiry date, otherwise my membership rate will be increased to the current standard membership rate.

11. Child Protection

11.1. The YMCA is committed to SAFEGUARDING CHILDREN & YOUNG PEOPLE and has a range of policies and procedures to keep children and young people safe. Details of these policies are available at: www.ymcabrisbane.org along with information on YMCA’s obligation to report child safety concerns, and how you can report child safety concerns.


12. Acknowledgement

12.1. I acknowledge that I have read and understood the terms and conditions of my YMCA fitness membership.

I agree to abide by all rules and regulations set forth by the YMCA.

I understand that failure to comply with these terms, including but not limited to inappropriate behaviour, misuse of facilities, or non-payment of membership fees, may result in the termination of my membership. The YMCA reserves the right to terminate my membership at its sole discretion if I do not adhere to these terms. I accept that in the event of termination, I will not be entitled to any refund of fees paid.
