Fitness Membership Terms & Conditions

By ticking “I agree”, you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions.

These Terms apply to all program enrolments conducted by YMCA Queensland (ABN 61 028 995 366) (“YMCA”, “we”, “us”, “our”).

1. Payment & Direct Debit Authority

Membership fees may be paid via cash, card, EFTPOS or direct debit. For Direct Debit Memberships, by providing your payment details, you authorise YMCA Queensland and its nominated payment provider to debit all fees and charges due under this agreement. Where a payment declines, you authorise the YMCA Queensland to retry or reschedule your payment to ensure your fees are current and up to date.

You are responsible for ensuring sufficient funds are available. Failed payments may incur additional fees and may result in suspension of access.

2. Cooling-Off Period

You may cancel this agreement within 48 hours of purchase (commencing 5:30am on the purchase date). Cancellation within this period will incur an administration fee equal to the lesser of $75 or 10% of the membership fee, plus the value of any services or facility use already accessed.

3. Cancellation

After the cooling-off period, fees are non-refundable except where required by law. Cancellation requests are not effective until received and confirmed by YMCA Queensland. Membership fees continue to be payable until cancellation is received and processed by YMCA Queensland.

Direct Debit Memberships

  • No minimum term: 30 days written notice required.
  • Minimum term contracts: 30 days written notice plus an early termination fee of $199 or the remaining contract balance (whichever is less).

Medical Cancellation

Medical cancellations may be approved where a member is unable to safely participate in exercise or use the facilities for a permanent or extended period (generally three (3) months or more) due to illness, injury or medical condition.

Examples may include permanent disability, serious injury, significant illness, medical advice to cease exercise, or pregnancy-related complications that prevent participation.

Requests must be submitted in writing and supported by documentation from a registered medical or allied health practitioner confirming the member is unable to participate for the relevant period. YMCA Queensland may request additional information where reasonably required.

Where approved, any refund or fee adjustment will be applied in accordance with this agreement and applicable administration fees, except where otherwise required by law. Temporary conditions may be managed through membership suspension instead of cancellation.

Memberships cannot be cancelled during any free membership period.

4. Suspension or Cancellation

Memberships may be suspended for $0.50 per day upon written request submitted in advance. Suspensions do not count toward minimum term or cancellation notice periods. YMCA Queensland may cancel or suspend a membership where a member breaches this agreement, fails to make payments, or poses a risk to health, safety, or property.

5. Membership Changes

Membership changes must be completed via reception or approved member systems. Members must keep their personal details accurate and current at all times. YMCA Queensland reserves the right to approve, refuse or limit membership changes.

6. Assumption of Risk

You acknowledge that participation in exercise, aquatic activities, programs and the use of YMCA facilities and equipment involves inherent risks that may result in injury, illness, permanent disability or death and that you participate voluntarily and entirely at your own risk.

These risks may include, but are not limited to:

  • Muscle strains, sprains, tears and soreness
  • Slips, trips, falls or collisions with equipment or other persons
  • Fractures, joint injuries, spinal injuries or dislocations
  • Overexertion, dehydration, fatigue or fainting
  • Equipment malfunction, misuse or failure to follow instructions
  • Aggravation of pre-existing injuries or medical conditions
  • Cardiovascular or medical events including heart attack, stroke or seizure
  • Drowning or aquatic-related injuries (where applicable)
  • Injuries caused by the actions or negligence of other participants
  • Psychological injury or illness

You further acknowledge that additional risks may exist when accessing facilities during unstaffed or 24/7 hours, including delayed emergency response, limited supervision and reliance on your own judgement in the use of equipment.

You confirm that you are medically and physically able to participate unless you have disclosed otherwise, and you voluntarily accept and assume all risks associated with participation and use of the facilities.

If you do not have the knowledge on use of any of the equipment, members must seek advice from a professional trainer and/or see the reception team to book in for a member induction.

7. Release & Indemnity

In recognition of the risk noted in section 6, to the maximum extent permitted by law, you release and indemnify YMCA Queensland, its officers, employees, volunteers and agents from any liability, loss, damage or claims arising from your participation, use of facilities, equipment or services. This clause does not exclude rights under the Australian Consumer Law.

8. Unstaffed / 24-7 Access (Where Applicable)

You acknowledge that accessing facilities during unstaffed hours carries additional risks, including delayed emergency response. You agree to accept this risk and also agree to comply with all conditions of entry, safety procedures, and access requirements which are made available to you prior to or at the time of access, including via YMCA Queensland’s website or member portal.

Non-use of facilities does not entitle you to refunds, credits or cancellation. YMCA may refuse entry or access at its discretion for safety, operational or behavioural reasons.

10. Facility Access, Closures & Changes

Facilities, services, programs, operating hours and access conditions may change from time to time, including temporary closures for maintenance, emergencies, staffing, public health directions or operational reasons.

To the extent permitted by law, such changes do not entitle members to refunds, credits or compensation.

YMCA Queensland is not responsible for loss, theft or damage to personal property, including items stored in lockers.

12. Medical Clearance & Health Warranty

By agreeing to this membership, you warrant that you are medically and physically fit to participate in exercise, programs and activities offered by YMCA Queensland.

You acknowledge that certain medical conditions may create increased risks during physical activity, including but not limited to cardiovascular conditions, respiratory conditions, musculoskeletal injuries, neurological conditions, pregnancy, recent surgery, or any condition that may be affected by physical exertion.

You agree that if you have any injury, illness, medical condition, symptoms (including chest pain, dizziness, shortness of breath, or fainting), or any other concern about your ability to safely participate, you will seek advice and clearance from an appropriately qualified medical practitioner before participating.

YMCA Queensland may require you to provide medical clearance prior to participation where reasonably necessary for health and safety.

You acknowledge that you participate voluntarily and at your own risk. You must immediately cease participation and notify YMCA Queensland if you experience any symptoms that may affect your safety.

13. Privacy

Personal information is collected and handled in accordance with the YMCA Privacy Policy available on the YMCA website or on request at your local service.

Concession means school/university student, or the holder of a Pensioner Concession Card issued by Centrelink, or a Gold Card issued by the Department of Veteran’s Affairs. Failure to maintain eligibility may result in fees reverting to the standard rate. The YMCA may request evidence of student card to support concessional or promotional pricing. Failure to provide evidence on request may result in full pricing being charged.

15. Safeguarding Children & Young People

YMCA Queensland is committed to safeguarding children and young people and maintains policies and procedures to support this commitment. Information is available on our website.

16. Australian Consumer Law

Nothing in this agreement excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.

17. Variation of Terms

YMCA Queensland may reasonably vary these terms, policies, fees or conditions from time to time. Members will be notified of significant changes in accordance with applicable laws. Continued use of facilities after notification constitutes acceptance of the updated terms. No oral statements or representations form part of this agreement.

18. Governing Law

This agreement is governed by the laws of Queensland, Australia.
